DECREE

AMENDING AND SUPPLEMENTING A NUMBER OF ARTICLES OF THE GOVERNMENT’S DECREE NO. 204/2004/ND-CP, OF DECEMBER 14, 2004 ON SALARY REGIME FOR CADRES, CIVIL SERVANTS, PUBLIC EMPLOYEES, AND ARMED FORCE PERSONNEL

 

 

Pursuant to the Law on Government organization of December 25, 2001;

At the proposal of the Minister of Home Affairs;

The Government promulgates the Decree on amending and supplementing a number of articles of the Government’s Decree No. 204/2004/ND-CP, of December 14, 2004 on salary regime for cadres, civil servants, public employees, and armed force personnel,

Article 1. To amend and supplement a number of articles of the Government’s Decree No. 204/2004/ND-CP, of December 14, 2004 on salary regime for cadres, civil servants, public employees, and armed force personnel (hereinafter abbreviated to the Decree No. 204/2004/ND-CP) as follows:

1. To amend point a clause 2 Article 7 as follows:

“Cadres, civil servants, public employees with excellent professional performances but yet enjoying the final salary grade within their salary schedule for their category or position shall be considered for one-step salary increment for a maximum of 12 months earlier than described in Point a and b, Item 1 of this Article.  For each year, the proportion of cadres, civil servants, public employees to be entitled to such accelerated salary increment must not exceed 10% of the total number of the staff members on their permanent salary payment list (except for cases listed in Point b, Item 2 of this Article)”.

2. To supplement subjects of application in Table 2 “Profession salary schedule applicable to cadres and civil servants in the State agencies” promulgated together with the Decree No. 204/2004/ND-CP as follows:

a) Civil servants of type A3:

4. To supplement the salary increment table for officers of the general level in the people’s army and the people’s public security force at the Table 6 “Salary increment schedule applicable to officers in the people’s army, and officers and non-commissioned officers in the people’s public security forces” promulgated together with the Decree No. 204/2004/ND-CP as follows:

Time limit of salary increment for Brigadier, Lieutenant general, Senior lieutenant-general and general shall be 4 years.

Article 2. Effect

1. This Decree takes effect on April 10, 2013.

2. The regime specified in clause 1 Article 1 of this Decree shall be entitled to raise salary grade before time limit due to excellent professional performances from 2012.

Article 3. Responsibility for implementation

1. The ministry of Home Affairs shall assume the prime responsibility for, and coordinate with Ministries, relevant agencies in guiding implementation of the salary-grade increment regime for cadres, civil servants, public employees.  

2. Ministers, Heads of ministerial-level agencies, Heads of Governmental agencies, the President of the People’s Committee of central-affiliated cities and provinces shall implement this Decree.
